Welcome to Specialist Trackers UK. These Terms of Sale govern the purchase of vehicle security products and related installation services from us through our website, by telephone, or by any other means. By placing an order with us, you agree to be bound by these Terms of Sale. Please read them carefully before making a purchase.

These Terms of Sale should be read together with our Privacy Policy, Cookie Policy, and Terms of Use. In the event of any conflict between these documents and any other content on our website, these Terms of Sale shall prevail in relation to your order.

1. Definitions

1.1 In these Terms of Sale:

"STUK", "we", "us", and "our" mean Specialist Trackers UK Ltd, a company registered in England and Wales (company number 14894745), VAT registration 477 9350 41.

"You" and "your" mean the person placing an order with us.

"Consumer" means an individual purchasing wholly or mainly outside the course of their trade, business, craft, or profession, as defined under the Consumer Rights Act 2015.

"Business Customer" means any purchaser who is not a Consumer, including limited companies, partnerships, sole traders purchasing for business use, and any person purchasing wholly or mainly for the purposes of their trade, business, craft, or profession.

"Product" means any vehicle security product (including but not limited to trackers, immobilisers, alarms, and dash cameras) supplied by us to you.

"Manufacturer" means the original manufacturer of the Product, with whom you contract directly for any subscription, monitoring, recovery, or related ongoing service associated with the Product.

"Authorised Installer" means an independent third-party installer engaged by us to perform installation work on your vehicle. Authorised Installers are qualified independent professionals who hold their own public liability insurance and operate to their own working methods.

"Vehicle" means the vehicle into which a Product is to be installed.

2. Formation of Contract

2.1 The display of Products on our website is an invitation to treat only and does not constitute an offer to sell at any indicated price.

2.2 Your placement of an order constitutes an offer by you to purchase the Product on these Terms of Sale.

2.3 No contract between you and STUK is formed until we send you an order confirmation by email accepting your order. We may decline to accept an order at our discretion, including but not limited to circumstances where the Product is out of stock, pricing or product information was incorrect on our website, we suspect fraudulent or unlawful activity, or we are unable to install the Product at your location.

2.4 If we cancel your order after payment has been taken, we will refund the payment to your original payment method.

2.5 By placing an order, you confirm that you are at least 18 years of age and legally capable of entering into binding contracts.

3. Price and Payment

3.1 All prices are displayed in GBP and include VAT at the applicable rate. Delivery and installation charges, where applicable, are shown at checkout.

3.2 We accept payment by major credit and debit cards and other payment methods displayed at checkout. Payment is taken at the point of order.

3.3 If a Product is incorrectly priced on our website, we are not obliged to supply at the incorrect price. We will contact you to offer the Product at the correct price or to cancel the order.

4. Delivery

4.1 We use a next-day courier service for deliveries within mainland UK. Orders placed before 3pm on a business day are dispatched the same day where stock permits.

4.2 We are not liable for delays caused by events beyond our reasonable control, including courier delays, weather disruption, or industrial action.

4.3 Once delivered to the address you have provided, the Product is your responsibility.

4.4 Due to geographic restrictions, Product availability and installation services may not extend to all locations. If we cannot deliver or install at your location, we will contact you to offer a refund or alternative arrangement.

5. Installation Service

5.1 Where you purchase an installation service alongside a Product, installation is performed by an Authorised Installer. STUK arranges and coordinates installation but does not install Products directly.

5.2 Authorised Installers are independent qualified professionals who carry their own public liability insurance, operate to their own working methods, and exercise their own technical judgement in carrying out installation work. STUK does not direct or control the manner in which an Authorised Installer performs installation.

5.3 Your pre-installation obligations: You must ensure that on the agreed installation date:

(a) the Vehicle is present at the agreed location, parked in a safe and accessible position, and accessible to the Authorised Installer;

(b) the Vehicle is in good working order, with a charged battery, the ability to start and drive, no significant electrical faults, and a working dashboard and OBD port (where the installation requires it);

(c) you (or an authorised representative aged 18 or over) are present to provide access, confirm requirements, and sign off the completed work;

(d) any additional hardware or vehicle-specific equipment we have advised you will be required is available.

5.4 If on arrival the Authorised Installer determines that the Vehicle is unsuitable for installation, the location is unsafe, or any of the conditions in clause 5.3 are not met, the installation may be cancelled and a cancellation fee will apply in accordance with clause 7.

5.5 Mobile installation is subject to weather conditions. If suitable shelter cannot be provided and the Authorised Installer determines conditions are unsafe, the appointment may be rescheduled.

5.6 Vehicle inspection on completion: You are responsible for inspecting the Vehicle for any cosmetic, electrical, or operational issues immediately on completion of installation, before the Authorised Installer leaves the site. Any concerns must be raised with the Authorised Installer at that time and reported to STUK in writing within 24 hours. We will not accept claims for installation-related issues that you have not raised within this period.

5.7 Pre-authorisation for remedial work: If you believe the Product or the installation is defective, you must contact STUK before incurring any third-party costs. We will assess the issue and, where appropriate, arrange remedial work through an Authorised Installer. We will not be liable for, and you will not be entitled to recover, any costs, invoices, or charges incurred without our prior written authorisation. You must allow STUK reasonable access to the Vehicle to investigate and rectify the issue within a period of 30 days from notification.

5.8 You may not permit any person other than an Authorised Installer engaged by STUK or by the Manufacturer to remove, relocate, modify, service, or repair an installed Product. Any unauthorised work voids the warranty in clause 9 and terminates STUK's liability in respect of the Product.

5.9 Some new, rare, or bespoke vehicles may incur additional installation costs, which will be discussed and agreed with you before the booking is confirmed. Some vehicles may not be compatible with our Products and we will advise alternatives where possible.

6. Subscription and Manufacturer Services

6.1 Where a Product requires a subscription, monitoring service, recovery service, or any other ongoing service from the Manufacturer, that service is provided directly by the Manufacturer to you under a separate contract between you and the Manufacturer.

6.2 STUK's role is limited to the supply and installation of the Product and the initial submission of your account setup information to the Manufacturer. STUK does not provide, control, or maintain any subscription, monitoring, recovery, or related service.

6.3 You are responsible for reviewing and accepting the Manufacturer's terms, privacy policy, and subscription arrangements before purchase. Disputes, service failures, subscription issues, recovery outcomes, and any data-related matters arising from the Manufacturer's service must be raised directly with the Manufacturer.

6.4 STUK has no liability for any failure, interruption, downtime, or limitation of any Manufacturer service, including but not limited to monitoring failures, recovery failures, account or subscription issues, app or platform availability, or data loss within the Manufacturer's systems.

7. Cancellations and 14-Day Right

7.1 Consumer 14-day cancellation right. Where you are a Consumer purchasing online or by telephone, you have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel within 14 days of delivery of the Product.

7.2 Waiver of the 14-day right for installation services. Where you book an installation appointment within the 14-day cancellation period and the installation has been performed, you expressly request that the installation service commences before the end of the cancellation period and acknowledge that you will lose your right to cancel the installation service once it has been performed. You will remain entitled to cancel and return the Product element in accordance with clause 8, subject to any deductions for installation services already supplied.

7.3 Cancellation fees. The following fees apply to cancellations or changes to bookings:

(a) Order cancelled before installation booking confirmed: £25 administrative fee.

(b) Installation booking cancelled more than 24 hours before the scheduled appointment: £85 cancellation fee.

(c) Installation booking cancelled within 24 hours of the scheduled appointment: £100 cancellation fee.

(d) Change to a confirmed installation booking (date, address, or Product): £25 administrative fee.

(e) Missed appointment (Authorised Installer arrives and you or the Vehicle is not present or available within 30 minutes of the agreed time): £100 cancellation fee.

(f) Change of mind on the day of installation, after the Authorised Installer has arrived, to remove a Product from a multi-Product installation: £100 per Product removed.

7.4 Refunds will be processed to the original payment method, less any applicable cancellation fee.

7.5 We are not liable for delays or cancellations beyond our reasonable control. If your booking is affected, we will work to reschedule or, where rescheduling is not possible, offer a refund for any unused Product element subject to standard return conditions.

8. Returns and Refunds

8.1 Where you are a Consumer, you may return an uninstalled Product within 14 days of delivery for a refund, provided the Product is in its original packaging, unused, and in the same condition as received. To initiate a return, contact us to obtain a Returns Authorisation (RA) number.

8.2 Returns will be processed within 14 days of our receiving and inspecting the returned Product. Refunds will be issued to the original payment method, excluding delivery charges unless the return is due to our error or the Product is faulty.

8.3 The following are not eligible for return:

(a) Products that have been installed;

(b) Custom or special-order Products;

(c) Software that is no longer in its original sealed packaging;

(d) Products that show signs of use or damage.

8.4 If a Product is faulty on arrival, contact us within 14 days. We will arrange replacement or refund at no cost to you, including the original delivery charges.

8.5 You are responsible for return shipping costs unless the Product is faulty or the return is the result of our error. We recommend using a tracked delivery service.

8.6 Business Customers do not have a statutory right of return. Returns from Business Customers are accepted at our sole discretion.

9. Warranty

9.1 Products supplied by STUK are covered by a 12-month warranty from the date of installation, or the date of delivery if no installation service was purchased. This warranty covers manufacturing defects in materials and workmanship under normal use.

9.2 The warranty does not cover:

(a) damage caused by misuse, neglect, abuse, or improper maintenance;

(b) damage caused by accident, modification, or external causes;

(c) damage caused by installation, removal, modification, repair, or maintenance carried out by any person other than an Authorised Installer or a Manufacturer-authorised technician;

(d) normal wear and tear or cosmetic damage;

(e) any failure or fault that originates with the Manufacturer's service rather than the Product itself;

(f) any consumable parts (including but not limited to backup batteries) beyond their reasonable expected service life;

(g) Products that have been tampered with or where serial numbers have been removed or altered.

9.3 To make a warranty claim, contact us with your order number, Product details, and a description of the issue. We will assess the claim and, where valid, arrange repair, replacement, or refund. Clause 5.7 (pre-authorisation for remedial work) applies to any third-party costs.

9.4 This warranty does not affect your statutory rights as a Consumer under the Consumer Rights Act 2015.

10. Performance Limitations

10.1 Not an anti-theft device. Vehicle security Products are aids to vehicle security. They do not, and STUK does not represent that they will, prevent theft, guarantee the recovery of a stolen Vehicle, or guarantee any specific security outcome. You acknowledge that the recovery of a stolen Vehicle depends on factors outside STUK's control, including but not limited to Manufacturer monitoring services, police action, network availability, and the actions of third parties.

10.2 Network coverage. Where a Product depends on GSM, GPRS, satellite, or other network signal, performance is subject to network coverage at the location of the Vehicle. STUK is not responsible for any failure or limitation of network coverage. It is your responsibility to consider whether network coverage is adequate at the locations where the Vehicle will be used.

10.3 Power dependency. Products that draw power from the Vehicle's battery require the battery to be maintained in working order. STUK is not liable for any failure of a Product caused by a flat, faulty, or disconnected vehicle battery.

10.4 Customer security obligation. You remain responsible for maintaining reasonable physical security of the Vehicle. A vehicle security Product does not replace standard security precautions.

11. Liability

11.1 Carve-outs. Nothing in these Terms of Sale excludes or limits our liability for:

(a) death or personal injury caused by our negligence or the negligence of our employees or Authorised Installers;

(b) fraud or fraudulent misrepresentation;

(c) any liability that cannot be lawfully excluded or limited, including your statutory rights as a Consumer under the Consumer Rights Act 2015.

11.2 Maximum liability cap. Subject to clause 11.1, our total liability to you, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with any order, shall not exceed the price paid by you for the Product to which the claim relates.

11.3 Excluded losses. Subject to clause 11.1, we shall not be liable to you, whether in contract, tort (including negligence), or otherwise, for:

(a) loss of profits, sales, business, or revenue;

(b) loss of contracts, agreements, or business opportunities;

(c) loss of anticipated savings;

(d) loss of or damage to goodwill or reputation;

(e) loss of, damage to, or theft of the Vehicle or its contents (where the Product has failed to prevent or assist recovery from such loss);

(f) any indirect, consequential, or special loss or damage of any kind.

11.4 Business Customer position. The exclusions in clauses 11.3(a) to (d) apply with particular force to Business Customers, who are deemed to have accepted the allocation of risk reflected in these Terms of Sale as a condition of purchase. Business Customers acknowledge that the price of the Products reflects this allocation of risk.

11.5 No personal claims against individuals. You agree that you will not bring any claim, whether in contract, tort, or otherwise, against any director, officer, employee, or Authorised Installer of STUK personally. Your sole recourse is against STUK as a company.

11.6 Time limit for claims. Any claim against STUK must be notified in writing within 30 days of the event giving rise to the claim, and any legal proceedings must be commenced within 12 months of the event, except where a longer period is required by law.

12. Customer Obligations and Indemnity

12.1 You confirm that you are the registered keeper of the Vehicle, or you have the express authority of the registered keeper, to have a Product installed in the Vehicle.

12.2 You confirm that the Product will be used for lawful purposes only. You will not use any Product to track, monitor, or surveil any person without that person's knowledge and consent, save where you are lawfully entitled to do so.

12.3 You agree to indemnify STUK against any claims, losses, damages, costs, or expenses incurred by STUK as a result of:

(a) your breach of these Terms of Sale;

(b) your unlawful or unauthorised use of any Product;

(c) any inaccurate or incomplete information you have provided to us;

(d) any third-party claim arising from your use of a Product.

13. Governing Law and Disputes

13.1 These Terms of Sale, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales.

13.2 Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that if you are a Consumer resident in Scotland or Northern Ireland, you may bring proceedings in the courts of your home jurisdiction.

13.3 Nothing in this clause affects your right as a Consumer to use any alternative dispute resolution scheme available to you under applicable law.

14. Changes to These Terms

14.1 We may update these Terms of Sale at any time by posting an updated version on our website. The version of these Terms of Sale in effect on the date your order is accepted will apply to that order. Continued use of our website following an update constitutes acceptance of the updated Terms in respect of any subsequent orders.
